PFAS Dashboard Subscription Terms of Service

These Terms of Service ("Terms") govern subscriptions to the PFAS Dashboard (the "Service") provided by Inogen Environmental Alliance ("we", "us" or "our"). By purchasing a subscription, you agree to these Terms on behalf of the company you represent ("you" or "Subscriber").
1. Eligibility
The Service is available to businesses only. Subscriptions must be purchased on behalf of a company, and by subscribing you confirm that you have authority to bind that company to these Terms. The Service is not offered to individuals acting for personal, family or household purposes.
2. Subscription plans
We offer three plans: the North America Dashboard at $600 per month, the Europe Dashboard at $800 per month and the North America and Europe Combined Dashboard at $1,200 per month. The geographic coverage of each plan is as described on the plan page at the time of purchase. We may update the data, features or coverage within a plan from time to time.
3. Authorized users and access
Your subscription includes access for users within your company ("Authorized Users"). You may nominate Authorized Users when subscribing and request changes by contacting us at pfashelp@inogenalliance.com.
You are responsible for your Authorized Users' use of the Service and for keeping access credentials and links confidential. Access may not be shared with anyone who is not an Authorized User, including affiliated companies, unless agreed with us in writing. We may suspend access if we reasonably believe it has been shared in breach of these Terms.
4. Billing and payment
Subscriptions are billed monthly in advance in US dollars, starting on the date of purchase, and renew automatically each month until cancelled. By subscribing, you authorize us to charge the applicable monthly fee to your payment method on each renewal date until you cancel.
Payments are processed by our third-party payment processor. We do not store full payment card details.
If a payment fails, we will email you a link to update your payment details. If payment is not received within 7 days, we may suspend or cancel your subscription and remove access.
5. Taxes
Fees are stated exclusive of taxes. You are responsible for any sales, use, value added or similar taxes that apply to your subscription, other than taxes based on our income. If you are located outside the United States and are registered for VAT or a similar tax, you should provide your registration number at checkout, and you are responsible for accounting for any tax due under the reverse charge mechanism where it applies.
6. Price changes
We may change subscription prices. We will notify you by email at least 30 days before a price change takes effect. If you do not wish to continue at the new price, you may cancel before the change takes effect.
7. Plan changes
To change plans, contact us at pfashelp@inogenalliance.com rather than purchasing an additional subscription. Plan changes take effect from your next billing date.
8. Cancellation
Subscriptions renew monthly until cancelled. You can cancel at any time using the link in your payment receipt email or by contacting pfashelp@inogenalliance.com. No further payments will be taken, and access continues until the end of your paid billing period. To change plans, contact us rather than purchasing a second subscription. If a failed payment is not updated within 7 days, your subscription may be cancelled.
9. Refunds
Fees are billed monthly in advance. Because access continues until the end of the paid period, we do not refund partial months or mid-period cancellations. Billing errors and duplicate charges reported within 7 days are refunded in full to the original payment method. To request a refund, contact pfashelp@inogenalliance.com.
10. Permitted use
Subject to these Terms and payment of fees, we grant you a non-exclusive, non-transferable right for your Authorized Users to access and use the Service for your internal business purposes during your subscription. Authorized Users may include limited extracts in internal reports and presentations, provided the source is acknowledged.
You must not resell, sublicense, publish or redistribute the Service or its data. You must not share access with anyone who is not an Authorized User, systematically download or copy the data to build a competing product or database, attempt to circumvent access controls or use the Service in breach of applicable law, including export control and sanctions laws.
11. Ownership
We and our licensors retain all rights in the Service, including the dashboards, data, analysis, software and content. No rights are granted except as expressly stated in these Terms.
12. Information only
The Service provides information for general reference. It does not constitute legal, regulatory, engineering, environmental or other professional advice, and you should not rely on it as a substitute for such advice. While we aim to keep the data accurate and up to date, we do not guarantee that it is complete, accurate or current, and regulatory requirements relating to PFAS may change.
13. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. The Service relies on third-party platforms, and access may be affected by maintenance, updates or events outside our control. We may modify features of the Service provided the overall functionality of your plan is not materially reduced.
14. Suspension and termination
We may suspend or terminate your access immediately if you materially breach these Terms, including by sharing access or redistributing data, or if payment is not made. Where termination results from your breach, no refund is due.
15. Disclaimer of warranties
To the extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
16. Limitation of liability
To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunity. Our total liability arising out of or relating to these Terms or the Service will not exceed the fees you paid to us in the twelve months before the event giving rise to the claim.
17. Privacy
We process personal information about you and your Authorized Users in accordance with our Privacy Policy.
18. Changes to these Terms
We may update these Terms from time to time. We will notify you by email of material changes at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
19. Governing law
These Terms are governed by the laws of Minnesota, and any disputes will be subject to the exclusive jurisdiction of the courts located in Minnesota, USA.
20. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Cancellation Policy, Refund Policy and Privacy Policy, form the entire agreement between you and us regarding the Service. You may not assign your subscription without our consent.
